August 25, 2026 / 2:50 PM EDT / CBS News Federal prosecutors are considering bringing criminal charges against an Immigration and Customs Enforcement officer who is accused of shooting a Venezuelan immigrant in the leg during the Trump administration's federal immigration surge in Minnesota in January, according to multiple sources familiar with the deliberations. The officer, Christian Castro, was charged in May by local prosecutors in Minnesota, and faces four counts of second-degree assault and one count of falsely reporting a crime after the January incident. Castro was arrested in Texas shortly afterwards and is currently in a jail in Cameron County, but Texas Gov. Greg Abbott has refused to extradite him to Minnesota. Last week, Minnesota Attorney General Keith Ellison sued Abbott, arguing that the state's move was unlawful .
