Mother already serving life sentence in son’s death, doesn’t need to be behind bars, judge says

The federal judge began the sentencing hearing with an unusual announcement, telling Ashlyn Johnson, seated at the defense table beside her lawyer, that she would not be going to prison. Johnson, 22, grabbed a tissue, bent her head down and covered her eyes. “I appreciate and understand the weight of this moment in your life,” U.S. District Judge Amy M. Baggio told her. “It seemed to me common decency required me to communicate to you I do not intend to send you to prison.” Johnson wiped tears from her eyes as her parents looked on from the courtroom’s public gallery. “Do you need a break?” the judge asked. Johnson said no, and the hearing resumed – somewhat backwards — with the prosecutor then asked to present her recommended sentence.

A day after her son died, she described her devastation: “My son it hurts knowing ur gone u was my purpose of life n reason for living …Please watch over me n help me im so broken n feel so lost. Pray u give me the strength to keep living n not give up in the end.” By June 2025, she asked for forgiveness more directly: “I just wanna say I’m sorry to everyone for my mistake of what has happened …I loved him so damn much n was struggling a lot during the time I was taking care of him …If I could trade places with him I would.” By this point, she was in treatment, and by all accounts dedicated to it.
