SANTA TERESA, N.M. – The New Mexico Supreme Court ruled in favor of Project Jupiter Thursday, unfreezing a key part of the permitting process. In August, the court paused part of the permitting process for the data center under construction in Doña Ana County, after two separate environmental challenges. The Center for Biological Diversity challenged emergency authorization for water from a newly constructed well. It argued state law does not treat the use as an emergency and that the use would require a public hearing. In a separate case, New Energy Economy challenged the pending air quality permit.
