Brown announced Tuesday that he will not prosecute the six officers involved in a fatal police shooting in Gaithersburg on July 12. Around 6:47 p.m. on July 12, the Montgomery County Police Department received a 911 call reporting that a man was loading a firearm at a bus stop in the 9600 block of Lost Knife Road in Gaithersburg. The caller's description of the man was broadcast to officers about a minute later; MCPD and Gaithersburg police officers were dispatched to the scene.

According to the Attorney General's Office, responding officers included Gaithersburg Police Sgt. Powers was pronounced dead at the scene. Investigators said that when officers began the evacuation, Powers raised his handgun in the direction of officers.
